Online Terms and Conditions

These terms and conditions apply to purchases made online at soundsleep.co.uk.

Terms for in-store purchases may differ.

A copy of these terms may also appear on the reverse of your invoice.

1. Definitions

In these Terms and Conditions the following definitions apply:

“You” or “Your” means the person named in the Order to whom we supply the Goods.

“We”, “Us”, or “Our” means Sound Sleep Limited, Aloe Farm, Mile Road, Winfarthing, Diss, Norfolk, IP22 2EZ.

“Order” means your order for Goods placed through our website.

“Goods” means all products listed in the Order.

“Special Order” means any goods made to a specific size, colour, finish or non-stock item ordered specifically for you.

“Delivery” means delivery of the Goods to the address specified in the Order.

2. General

2.1 These Terms and Conditions apply to all orders placed through our website.

2.2 By placing an Order you confirm that you have read and accepted these Terms.

2.3 If you do not agree with these Terms you should not place an Order.

2.4 These Terms do not affect your statutory rights.

3. Orders

3.1 You should carefully check the details of your Order before completing your purchase.

3.2 Once your Order is placed you will receive an email confirmation. This confirms that a contract has been formed between you and Sound Sleep Limited.

3.3 If there are any errors in your Order confirmation you must notify us as soon as possible.

3.4 It is your responsibility to ensure:

(a) the dimensions of the Goods will fit into your property;

(b) access routes, stairways and doorways are suitable for delivery;

(c) any additional services (such as assembly or recycling) are included in the Order.

3.5 If additional services are not shown in the Order they have not been purchased and will not be provided.

3.6 All Orders are subject to acceptance and all details supplied must be accurate.

3.7 Images on soundsleep.co.uk are representative only. Colours, fabrics and mattress tickings may vary slightly.

4. Pricing Errors

4.1 If a product is displayed with an incorrect price we reserve the right to cancel the Order before the contract is fulfilled.

4.2 Any inaccurate product descriptions will be corrected as soon as possible.

5. Goods

5.1 The description of the Goods will be as stated in the Order.

5.2 Please note:

(a) all sizes are approximate and bed sizes refer to the sleeping surface only;

(b) mattresses may vary slightly in size due to manufacturing tolerances;

(c) firmness ratings are for guidance only and comfort is subjective.

6. Guarantee

6.1 We guarantee that for 12 months from the date of delivery the Goods will:

be of satisfactory quality

be fit for their intended purpose

be free from material defects

comply with UK statutory requirements.

6.2 This guarantee applies to normal domestic use only.

6.3 The guarantee does not cover defects caused by:

normal wear and tear

accidental or deliberate damage

misuse or negligence

commercial use

failure to follow care instructions

unauthorised alterations or repairs.

6.4 If you believe the Goods breach this guarantee we may arrange an inspection.

6.5 If the Goods are found not to breach the guarantee, no further action will be taken.

6.6 If the Goods are found to be defective we will, at our discretion:

repair the Goods

replace the Goods

or issue a refund where replacement is not possible.

6.7 The guarantee period continues from the original delivery date.

6.8 The guarantee is void if:

(a) the mattress is used on an unsuitable base;

(b) the mattress has been excessively bent during installation;

(c) the mattress is stained or marked.

A waterproof mattress protector is strongly recommended.

7. Availability

7.1 All goods are subject to availability.

7.2 We reserve the right to withdraw products without notice.

7.3 If goods cannot be supplied you will receive a full refund.

7.4 Where goods are not in stock an estimated lead time will be provided. These lead times are supplied by manufacturers and may change.

8. Price and Payment

8.1 The price payable will be the amount shown in the Order.

8.2 Prices may change at any time but confirmed Orders will not be affected.

8.3 All prices are in pounds sterling (£) and include VAT.

8.4 Payment is taken at the time of ordering.

8.5 Payments are securely processed via Shopify.

8.6 The payment card must:

belong to the person placing the Order

be registered to a UK account

be used by a person aged 18 or over.

8.7 Incorrect billing information may result in cancellation of the Order.

9. Delivery

9.1 Delivery will be made to the address stated in the Order.

9.2 Delivery lead times are estimates and may change.

9.3 Delivery is deemed complete when the Goods are delivered to the address provided.

9.4 Our delivery service includes delivery to the room of choice where access allows.

9.5 Failed deliveries may incur a £50 redelivery charge.

9.6 If delivery cannot be completed due to access restrictions or the Goods not fitting:

(a) a replacement product may be chosen;

(b) if the replacement product costs more, you must pay the difference;

(c) if the replacement product costs less, the difference will not be refunded;

(d) an additional delivery charge may apply.

9.7 Beds or headboards ordered in a specific colour are non-returnable.

9.8 If assembly has been purchased this will be completed by the delivery team.

9.9 Goods should be inspected upon delivery.

9.10 Goods assembled by our team are deemed accepted unless issues are reported immediately.

9.11 Where goods remain packaged they will be deemed accepted 7 days after delivery.

9.12 Customers must ensure safe and clear access for delivery. We may refuse room delivery where access is unsafe.

10. Consumer Cancellation Rights (Distance Selling)

10.1 Under the Consumer Contracts Regulations 2013, you have the right to cancel your Order within 14 days of receiving the Goods.

10.2 To exercise this right you must notify us in writing by email.

10.3 The Goods must be returned unused and in their original packaging.

10.4 Customers are responsible for return costs unless the Goods are faulty.

10.5 Refunds will be issued within 14 days of receiving the returned Goods.

10.6 The cancellation right does not apply to Special Orders, including goods made in a specific size, colour or specification.

11. Returns

11.1 Goods returned must be unused and in a hygienic condition.

11.2 Mattresses that are stained, marked or used without protection may not be eligible for return.

11.3 Refunds will be made to the original payment method.

12. Limitation of Liability

12.1 We are responsible for foreseeable loss or damage caused by our breach of contract.

12.2 We are not liable for indirect losses including:

loss of business

loss of profit

loss of opportunity.

12.3 Nothing in these Terms excludes liability for:

death or personal injury caused by negligence

fraud

any rights that cannot legally be excluded.

13. Force Majeure

13.1 We will not be liable for failure to perform our obligations where this is caused by events beyond our reasonable control, including:

supply chain disruption

natural disasters

strikes

transport delays

government restrictions.

14. Data Protection

14.1 Your personal information will be processed in accordance with UK data protection legislation.

14.2 We will only use your information to fulfil your Order and provide customer service.

15. Governing Law

15.1 These Terms are governed by the laws of England and Wales.

15.2 Any disputes will be subject to the jurisdiction of the courts of England and Wales.
